BreakingNews 31/12/15 - Appeal Court Declares Alex Otti Winner of Abia Governorship Election

[ Masterweb Reports ] - The Court of Appeal sitting in Owerri today declared Dr. Alex Otti, governorship candidate of All Progressive Grand Alliance (APGA) winner of last Abia State governorship election. The court also declared him winner of the April 11 and April 25 supplementary elections in the state. The court in its ruling ordered the swearing-in of Otti as governor, ordering Dr. Okezie Ikpeazu, current governor of the state vacate the office.

 

The five-member panel of the court headed by Justice Oyebisi Omoleye, said Otti got 164, 444 valid votes to defeat Ikpeazu who recorded 114, 444 votes. Justice Omoleye said the cancellation of elections held in three local government areas of Obingwa, Osisioma Ngwa and Isiala Ngwa by the returning officers after the results were uploaded to INEC was illegal. In his words: “In the Electoral Act, the Returning Officer has the right to only declare results of elections and not to cancel elections. This panel discovered that the earlier results uploaded to INEC headquarters correspond with the correct valid registered voters in the three LGAs, while that awarded to the respondent shows over voting and therefore null and void.’’
