BreakingNews 24/5/16 - EFCC gets court order to remand Fani-Kayode for 21 days

[ Masterweb Reports: Nurudeen Oyewole reports ] - The Chief Magistrate Court sitting in Ikeja has granted a remand application brought before it by Economic and Financial Crimes Commission (EFCC) seeking to remand former Aviation minister, Mr. Femi Fani Kayode over an alleged N1.4 billion fraud.‎
 

‎While granting the anti-graft agency’s request, presiding Chief Magistrate, Bola Osunsanmi said the former minister failed to exhibit any document before the court to show that he had been charged before any court for the alleged offence and as such should be kept in custody for 21 days pending his arraignment at an appropriate court.
 
Fani-Kayode was the Director of Media in the dissolved re-election campaign team of former President Goodluck Jonathan. He was said to have been named as a beneficiary of the ‎arms probe scandal to the tune of N1.4 billion.
 

‎Counsel to EFCC, Mr. A. N. Anana had argued before the court that the remand application was issued in pursuant to Section 261 of Administration of Criminal Justice Act, ACJA, 2011, of Lagos State, pending the time Fani-Kayode would be properly arraigned at the appropriate court.
 

But in a counter-submission, counsel to Fani-Kayode, Wale Balogun informed the court that the EFCC by its application was actually breaching his client’s constitutional rights because he had been granted an administrative bail by the EFCC but was never allowed to perfect it.
 

In her ruling, Osunsanmi said since Fani-Kayode could not prove before the court that he was being tried for the same offence in another court, his objection to the application could not stand.
